Selling products to public from a PMA

Question= If a PMA sells a product line only to its members, and there are Businesses who are part of the PMA, and they in turn resell those products to members of the public, does that put the PMA at risk, even if it has provided clear disclaimers in regards to its products being available only to members of the PMA?



Answer= Great question!! It reminds me of that case where that guy got in lots of trouble because a tag was still attached claiming what the machine could do...and that tag had been intended for members only....would love to hear the answer…/////   I would say yes because whatever we say/do in the public is technically under public jurisdiction... Just like how I as an individual cannot teach a class, post on fb, etc that you can use peppermint oil for a headache or lavender oil for a burn because the FDA regulates it but in a PMA group I can say it. It's also why our marketing in the public should remain compliant to public domain standards. There's a fine line and I admit I don't even know exactly where it is but I know the general area and I would be concerned about that
